5) AGREEMENT AND SALES AGREEMENT, DELIVERY TIMES, PAYMENT AND DELIVERY METHODS

9. Sales Agreements may be concluded via the Online Store with the following methods and dates of Product delivery:

a. The Product is delivered to the Customer by courier, pallet or in another manner specified by the Seller in the Product description or at the latest when placing the Order.
b. The cost of delivery of the Product (including transport, delivery and postal fees) is indicated to the Customer at the latest when placing the Order using the Order Form.

c. The delivery time for the Product to the Customer within the territory of the Republic of Poland is 2 to 3 Business Days, unless a shorter period is specified in the Product description or when placing the Order. In the case of Products with different delivery times, the delivery time is the longest period specified, which, however, cannot exceed 3 Business Days.

The beginning of the Product delivery period is counted as follows: (1) from the moment the Service Provider performs the Intermediation Service and concludes a Sales Agreement with the Seller for the Customer in accordance with point 5.2 of the Regulations – in the event that the Seller of the Product is a third party in relation to the Service Provider; or (2) from the moment of payment by the Customer, i.e. crediting the Service Provider’s bank or settlement account – in the event that the Service Provider acts as the Seller of the Product.

d. The delivery time for the Product to the Customer within the territory of European Union member states (excluding the Republic of Poland) is 2 to 3 Business Days, unless a shorter period is specified in the Product description or when placing the Order. In the case of Products with different delivery times, the delivery time is the longest period specified, which, however, cannot exceed 3 Business Days.

e. Orders with delivery within the United States of America (USA) are shipped from warehouses located in the US. The estimated delivery date is 2 to 3 Business Days, if such a date is specified for the Product and delivery address. In other cases, the delivery date communicated to the Customer prior to placing the Order applies. The delivery dates provided take into account the terms and conditions of the specific Order. In the event of an anticipated delay in shipment, the Customer will be informed of the delay, the proposed new date and his rights, including the right to cancel the Order and receive a refund in accordance with the relevant mandatory provisions of law. The beginning of the Product delivery period is counted as follows: (1) from the moment the Service Provider performs the Intermediation Service and concludes a Sales Agreement with the Seller for the Customer in accordance with point 5.2 of the Regulations – in the event that the Seller of the Product is a third party in relation to the Service Provider; or (2) from the moment of payment by the Customer, i.e. crediting the Service Provider’s bank or settlement account – in the event that the Service Provider acts as the Seller of the Product.

f.Orders may be fulfilled and shipped directly by the Seller or a supplier cooperating with the Seller, from a warehouse located in the country of delivery or from another country, depending on the availability of a given Product, taking into account the rules regarding deliveries to the USA set out in point e. In the case of domestic delivery from a warehouse located in the USA to an address in the USA, the Customer is not obliged to perform import clearance for the delivery of the shipment itself. For deliveries to other countries, if the Order involves the import of the Product, customs duties, import taxes, or other fees may apply in accordance with the regulations of the delivery country. Detailed rules regarding such fees are set forth in Section 3 of the Terms and Conditions. Any sales taxes and shipping costs will be presented to the Customer in accordance with applicable regulations before placing the Order.
